The availability of re-establishment of rights for European patent (EP) validations in Turkey has recently become increasingly controversial following conflicting decisions of the Turkish Court of Cassation.

Our article, published in the AIPPI Newsletter, examines whether Article 12 of the EPC Implementing Regulation in Turkey truly excludes re-establishment of rights, or whether a different and more coherent interpretation remains possible under Turkish law.
