Design Protection Term
The initial term of protection provided for design is 5 years starting from the date of application. The respective period can be extended for 25 years at most, in 5-year renewals.
When is the due date?
The request for renewal shall be submitted in the 6-month period before the expiry date of the registration and the information regarding the payment of the fee needs to be submitted to the Turkish Patent and Trademark Office (the “Office”) within the same period.
If the request for renewal is not made or the information regarding payment of the renewal fee is not submitted to the Office by the due date, the renewal request may be submitted and the renewal fee may be paid within a further period of 6 months following the expiry date of the registration, provided that an additional fee for late payment of the renewal fee or late submission of the request for renewal is paid within this period.
Unless the request for renewal is made and the renewal fee is paid within the respective additional 6 months, the design rights will expire.
Renewal Fees
Renewal fees are updated each year. Renewal fees to be applied in the respective year are announced in the fee tariff which is published at the beginning of each year in the Official Gazette.
Design registrations are made through either single applications or multiple applications, and the renewal fee to be paid varies accordingly.
The renewal fees, which are valid for 2024, are listed below.
For a single design or the first design in multiple applications:
Within 6 months before the expiry date of registration: TRY 3,432
Within 6 months after the expiry date of registration: TRY 5,724
For each additional design included in the same multiple applications:t
Within 6 months before the expiry date of registration: TRY 183
Within 6 months after the expiry date of registration: TRY 325
